OFFICIAL CONTEST RULES

NO PURCHASE NECESSARY TO ENTER

1. By entering this CONTEST (the "Contest") and accepting the terms herein, you agree to be bound by the following rules ("Official Rules"), which constitute a binding agreement between you, on one hand, and Marimba Productions, Inc. (“MPI”), on the other. MPI and any website companies hosting and promoting the Contest, their respective parent companies, affiliates, subsidiaries, advertising and promotion agencies, and all of their agents, officers, directors, shareholders, employees, and agents are referred to as the Contest Entities. These Official Rules apply only to the Contest and not to any other offers sponsored by MPI.

2. ELIGIBILITY: This Contest is open to anyone thirteen years of age or over, and is either currently enrolled in a secondary/high school, college, university, or graduated from a college or university ("Entrants"). Entrants must have a valid Facebook account and “like” both the Malletech Facebook page (
www.facebook.com/malletech) and MostlyMarimba Facebook page (www.facebook.com/mostlymarimba) to be deemed eligible to enter. If you are under the legal age of majority in your state of residence (a "Minor"), by submitting an entry, you declare that one of your parents or legal guardians have read, understood and agree to these Contest rules with your entry, and that such agreement constitutes acceptance of these Contest rules on behalf of you and themselves. Entrants will be divided into two divisions based on their educational status: High School and College/Professional. Employees, and their immediate families of MPI are not eligible to enter. VOID WHERE PROHIBITED BY LAW. By entering this Contest, each entrant agrees to release and hold harmless Contest Entities from any injury, loss, death, damage, action, claim, demand or other liability that may occur from entrant's participation in this Contest or from the acceptance, use or misuse of any prize awarded, or attendance at any event. MPI reserves the right to verify eligibility qualifications of any entrant or winner. U.S. law governs this Contest.

3. HOW TO ENTER: Each CONTEST begins upon MPI's posting at
www.mostlymarimba.com, its social media platforms, and newsletters, a request for the submission of performance videos. MPI will state in its initial CONTEST posting the compositions to be performed and the length of time for which it will accept CONTEST submissions. All CONTEST submissions must be made through the Website www.facebook.com/mostlymarimba as follows:

Step 1: Upload an “unlisted” video that meets the following conditions to
www.youtube.com.

  1. The video must be one continuous camera shot of one performance of the composition in its entirety. The video may not contain any editing, splicing of multiple takes or audio/video overdubbing.
  2. Entrant is to announce their first and last name, home city and state, school they attend/graduated from, the title of the composition and the composer of the composition. Entrant may also state his teacher’s name if desired.
    1. Example: “Hello. I am John Smith from New York, NY. I attend New York University, where I study with Dr. Jane Doe. I will be performing the C Major Etude by Musser.”
  3. All reasonable efforts must be made within the Entrant’s means and ability to acquire the highest quality audio possible in the recording.

Step 2: Visit www.facebook.com/mostlymarimba.
Step 3: Click “Send a Message.” In the popup chat box, send the link to the unlisted Youtube video submission.

In the case of Duet Performance Entries, one video submission made by one representative member of the ensemble will suffice to enter.

MPI will send all submissions to a panel of judges solely determined by MPI. The judges, in their sole discretion, will choose a winner from the submissions received. The winner will be chosen based on their technical accomplishment, artistry and musicality.

All videos submitted as part of the Contest shall become the property of MPI. The submission shall constitute an assignment of the copyright and all other rights to the entry.


4. CONDITIONS OF ENTRY: An eligible entry must be received via www.facebook.com/mostlymarimba as described above. Incomplete entries, or attempted entries via other means (e.g. email attachments, platforms other than Facebook, etc.) may be declared void. By entering, Entrants agree to comply with these Official Rules, including all eligibility requirements. Entry will be deemed submitted by the authorized account holder of the Facebook account from which the entry is made. MPI is not responsible or liable for lost, stolen, mutilated, incomplete, incorrect, delayed, late, interrupted, illegible or misdirected entries.

By submitting a video, Entrant understands and agrees that the composition performed is copyrighted by MPI, that MPI is granting a non-exclusive, mechanical and public performance license pro bono to the Entrant for the exclusive purpose of the Contest, and that use of the submission video for any reason outside the Contest violates the terms of the license and requires additional permission from MPI.

MPI reserves the right to modify, suspend, or terminate the Contest in whole or in part by giving such notice, in any form and manner deemed appropriate by MPI. Should promotion be modified, suspended, or terminated as aforesaid, the prizes will nevertheless be awarded from eligible entries previously received and in accordance with these Official Rules.


5. DETERMINATION OF THE WINNERS: The Winners will be selected based on the criteria set forth above from among all eligible online entries received by the deadline date. Selection of the Winner shall be conducted by a panel of judges, selected solely by MPI and under the supervision of MPI. MPI will notify the Winner using the Facebook account associated with your entry.  Failure to provide an accurate, working Facebook account through which MPI can contact you will disqualify you from receiving the contest prize.

6. PRIZES:

In the case of Solo Performance Entries:
One (1) Grand Prize Winner in the High School division will receive a $150 gift certificate to
www.mostlymarimba.com. The Grand Prize Winner’s entry video will also be promoted and distributed through MPI and Malletech’s websites, e-mail newsletters and/or social media platforms.

One (1) Grand Prize Winner in the College/Professional division will receive a $300 gift certificate to www.mostlymarimba.com. The Grand Prize Winner’s entry video will also be promoted and distributed through MPI and Malletech’s websites, e-mail newsletters and/or social media platforms.

Two (2) High School division Runners-Up and Two (2) College/Professional division Runners-Up will have their entry video promoted and distributed through MPI and websites, e-mail newsletters and/or social media platforms.

In the case of Duet Performance Entries:
One (1) Grand Prize Winner in the High School division will receive a $250 gift certificate to
www.mostlymarimba.com. The Grand Prize Winner’s entry video will also be promoted and distributed through MPI and Malletech’s websites, e-mail newsletters and/or social media platforms.

One (1) Grand Prize Winner in the College/Professional division will receive a $500 gift certificate to www.mostlymarimba.com. The Grand Prize Winner’s entry video will also be promoted and distributed through MPI and Malletech’s websites, e-mail newsletters and/or social media platforms.

Two (2) High School division Runners-Up and Two (2) College/Professional division Runners-Up will have their entry video promoted and distributed through MPI and Malletech’s websites, e-mail newsletters and/or social media platforms.

Prizes for Duet Performance Entries are awarded to the ensemble as a whole; prizes detailed are not awarded per ensemble member. Once an Entrant is declared a Grand Prize Winner or Runner-Up of a Contest, he is ineligible from winning a Prize for ninety (90) days from the date he is announced as a Grand Prize Winner or Runner-Up.

7. GENERAL CONDITIONS: All Grand Prize Winners and Runners-Up (collectively the “Winners”) agree to grant to MPI and MPI's licensees, affiliates and assigns, the right to print, publish, broadcast and use, worldwide, in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the Winner's name, portrait, picture, voice, likeness and biographical information as news or information and for advertising and promotional purposes without additional consideration. By accepting a prize, Winner agrees to release and hold harmless MPI, their parent, subsidiaries, licensees, affiliates, subsidiaries, advertising and promotion agencies, and their respective directors, officers, employees, representatives, and agents from any and all liability for any injuries, loss, or damage of any kind to person, including death, and property arising whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any Contest-related activity, or participation in this Contest.
